Welcome to Tree Plant Rescue (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website treeplantrescue.com (the “Site”), including any content, functionality, and services offered on or through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.

These Terms form a legally binding agreement between you and Tree Plant Rescue, an organization dedicated to rescuing and planting trees to promote environmental sustainability. We reserve the right to modify these Terms at any time, and such changes will be effective upon posting on the Site. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

1. Use of the Site

Eligibility

You must be at least 13 years of age to use the Site. By using the Site, you represent that you meet this requirement and that you are not barred from using the Site under applicable law.

Permitted Use

The Site is for informational and participatory purposes, including learning about our tree rescue initiatives, signing up for events, making donations, and sharing stories. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

•  Use the Site in any way that violates applicable federal, state, local, or international laws or regulations.

•  Engage in conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which may harm us or users of the Site.

•  Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

User Accounts

To access certain features, such as event registration or newsletters, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 2. Donations and Payments

Donations to Tree Plant Rescue are voluntary and non-refundable, except as required by law. By making a donation:

•  You authorize us to charge your payment method for the amount specified.

•  All donations are final and support our tree rescue and planting programs.

•  We use third-party payment processors (e.g., Stripe or PayPal) for secure transactions. You agree to their terms and privacy policies.

We do not guarantee tax deductibility; consult a tax advisor for details.

3. User-Generated Content

The Site may allow you to submit content, such as comments, photos, or stories about tree rescues (“User Content”). By submitting User Content, you:

•  Grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, distribute, modify, and display it in connection with the Site and our mission.

•  Represent that you own or control all rights in the User Content and that it does not infringe any third-party rights.

•  Agree that we may moderate, edit, or remove User Content at our discretion, including for violations of these Terms.

You retain your ownership rights in User Content but understand that once shared, it may be publicly visible.

4. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by Tree Plant Rescue or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from Site content without our prior written consent, except as permitted by fair use or other applicable laws for personal, non-commercial purposes.

5. Third-Party Links and Services

The Site may contain links to third-party websites or services (e.g., social media or donation platforms). These links are provided for convenience only, and we do not endorse or control them. Accessing third-party sites is at your own risk, and you should review their terms and privacy policies.

6. Disclaimers and Limitation of Liability

Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Information on the Site is for general guidance and not professional advice.

Limitation of Liability

To the fullest extent permitted by law, Tree Plant Rescue, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the past 12 months (or $100 if no payment was made).

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Riverside County, California. You waive any objection to venue or inconvenience of forum.

10. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Site. If any provision is held invalid, the remainder shall continue in full force. Our failure to enforce any right does not waive it. You may not assign these Terms without our consent; we may assign them freely.
